Puppy Health/Adoption Contract
This agreement is made and entered into this ____ day of ______ by and between Carla and Benjamin Williamson. (Seller/Breeder), and _____________________________________(Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred Cane Corso puppy from the litter whelped on January 2, 2009. Out of Sadie Lady of Ridge Lawn and sired by Sir Igor of Galloway both of Chatham Cane Corsos. For the price of $________, the seller agrees to sell and the buyer agrees to purchase a (sex and color) puppy intended as a companion dog from the litter described above subject to the following terms and conditions: 1. Seller warrants that the above-described puppy/dog is a purebred Cane Corso registerable with the International Cane Corso Federation (ICCF) and that the registration papers will be provided to the buyer. ICCF (International Cane Corso Federation), FCI (Federation Cynologique Internationale), FCPR (Federation Cynagloque Puerto Rico), ENCI (Ente Nazionale Cinofilia Italiana), AICC (Associazione Italiana Cane Corso), or SACC (Societa Amatori Cane Corso). 3. Seller warrants that the above-described puppy/dog is in good health and has received age appropriate vaccination(s) and worming(s) at the time buyer assumes ownership. Buyer agrees to have puppy examined by a licensed Veterinarian within ( ) days (not including weekends and holidays) of receipt of puppy/dog a. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health then the buyer shall elect to keep the puppy/dog or return the puppy/dog to the seller for a refund. If the buyer elects to return the puppy, buyer shall within 10 days after the date of signing this contract, send to seller a written veterinarian’s certificate stating that the puppy/dog was in ill health when examined. Upon receipt by seller of said certificate, buyer shall be obligated to return the puppy/dog to seller at buyer’s expense. Puppy/dog shall be returned in the same manner in which it was picked up, unless seller agrees to an alternate mode of transportation. Upon receipt of the puppy/dog, the seller shall refund the purchase price received from buyer toward purchase price of the puppy/dog, and further performance under this contract shall be null and void. 4. Said puppy/dog will also be warranted against any genetic problems for 2 years from date of purchase. If said puppy/dog is found to have a genetic problem, we the breeder have the right to have any veterinarian that we deem competent give a second opinion. If both opinions are same we reserve the right to replace said puppy/dog with one of our choice from a future litter or if we see fit we may settle on a full or partial refund. To file a replacement claim for this issue the dog must be x-rayed no earlier than two years of age and no later than 26 months of age and the x-ray must be evaluated by the OFA (Orthopedic Foundation for Animals) to be eligible for a replacement. All x-rays and evaluations will be done at the owner’s expense. If the OFA report shows a hip grade of Moderate Hip Dysplasia or Severe Hip Dysplasia (x-ray taken between 24 month and 26 months only) consequently if the dog is bred before the age of two then the breeder/seller will no longer be responsible to fulfill any promises made in this contract. 5. Buyer agrees that if it becomes necessary to give away , sell or otherwise dispose of this puppy/dog, for any reason, buyer will notify seller before taking such actions so that seller may assist in finding a new home for the puppy/dog or the seller will take the dog back herself without question; BUYER AGREES NOT TO PLACE THE DOG IN ANY RESCUE FACILITY; BUYER WILL RETURN THE PUPPY TO BREEDER (SELLER) (AT BUYERS EXPENSE) OR AT LEAST ALLOW BREEDER TO BE INVOLVED IN FINDING SUITABLE HOME. 6. Buyer agrees that the puppy will reside in the home of the Buyer, and be provided with a good quality diet, and all age appropriate shots, and worming on regular schedule as detailed by seller. 7. Buyer also agrees that this puppy/dog will not be used as a guard dog for any business, nor will it be used in the sport of dog fighting/combat. This agreement is made and signed by both parties to insure the well-being and protection of this puppy/dog. If the buyer breaches any part of this agreement, the seller is released from any obligations under this agreement. This agreement is non-transferable and is governed by the laws of the state of Ohio.
